September 10: Report Tips to Your Employer

If you are an employee who works for tips and received more than $20 in tips during August, you must report them to your employer no later than September 10. You can submit this information using IRS Form 4070 or a custom statement. Your custom statement must include your signature; name, address, and Social Security number; employer’s name (or establishment’s name) and address; the covered month or period, and the total tips received during that timeframe.

Your employer is required to withhold income tax and FICA taxes for these tips from your regular wages. If your base pay is insufficient to cover the required tax withholding, your employer will report the uncollected amount in box 8 of your W-2 for the year. You will then be responsible for paying that uncollected withholding when you file your annual return.

September 15: Third Quarter Estimated Tax Payment Due

The third installment of 2026 individual estimated taxes is due on September 15. The federal tax system operates on a “pay-as-you-earn” basis, meaning taxes must be paid as income is generated. The government facilitates this through several channels:

  • Payroll withholding for employees
  • Pension withholding for retirees
  • Estimated tax payments for self-employed individuals and those with income sources not covered by withholding

Failing to prepay a minimum “safe harbor” amount can trigger an underpayment penalty. The IRS calculates this penalty quarter-by-quarter, charging the federal short-term rate plus 3 percentage points.

Fortunately, federal tax law offers specific ways to avoid this underpayment penalty. First, no penalty is assessed if your underpayment is less than $1,000 (the de minimis amount). Additionally, the law provides two primary safe harbor prepayment exceptions:

  • Current Year Safe Harbor: You escape the penalty if your payments equal or exceed 90% of the tax owed in the current year.
  • Prior Year Safe Harbor: This safe harbor generally requires prepaying 100% of your prior year’s tax liability. However, for taxpayers with an Adjusted Gross Income (AGI) exceeding $150,000 ($75,000 for married taxpayers filing separately), this prior year safe harbor threshold increases to 110%.

Real-World Safe Harbor Example

Suppose your total tax liability for the year is $10,000, and your prepayments total $5,600. That leaves you owing an additional $4,400 when filing. To determine if a penalty applies, you first check the current year safe harbor exception. Since 90% of $10,000 is $9,000, your $5,600 in prepayments falls short. You cannot avoid the penalty under the first exception.

However, you might still qualify under the prior year safe harbor. Assume your prior year’s tax was $5,000. For high-income earners requiring the 110% threshold, that safe harbor target is $5,500. Because you prepaid $5,600, you have met the second safe harbor requirement and will escape the penalty entirely.

This example highlights exactly why adequate prepayments are crucial, especially if you experience a substantial increase in income from large bonuses, the sale of property or stocks, or retirement distributions. To qualify for the safe harbor exceptions, you must also make your required estimated tax installments on time. If you have questions regarding your safe harbor estimates, call our office as soon as possible.

CAUTION: Some state de minimis amounts, safe harbor estimate rules, and estimated payment due dates differ from federal guidelines. Please contact this office for particular state safe harbor rules.
