Could Your Dog Qualify for a Tax Break? Navigating New Pet Expense Proposals

Americans spend billions of dollars each year caring for their pets. For many of the hard-working entrepreneurs we partner with—from trucking operators to construction firm owners—dogs and cats are much more than just pets; they are part of the family. But with the lifetime cost of owning a dog approaching $30,000 nationwide, keeping them healthy and happy has become a significant line item in the household budget.

While federal law has traditionally offered zero relief for these expenses, a wave of new state-level legislative proposals could eventually change how we view pet ownership on our tax returns. Let us look at the current proposals and what they might mean for your overall financial picture.

The New Jersey Proposal: Up to $900 for Pet Expenses

At the center of the current conversation is New Jersey, where lawmakers are reviewing a proposal that would provide qualifying pet owners with targeted tax relief. If passed, the bill would offer an annual credit of up to $900 per taxpayer to help offset the rising costs of animal care.

Specifically, the proposal breaks down into two main categories: up to $300 annually for everyday pet expenses (such as food, crates, grooming supplies, and toys) and up to $600 annually for veterinary expenses, including exams, medications, and emergency care. Taxpayers would be required to provide documentation proving ownership of a qualifying cat or dog, alongside receipts for eligible expenses.

While the legislation remains in committee, it poses a compelling question for tax professionals and taxpayers alike: Should governments provide tax relief for pet ownership just as they do for other household expenses?

A Growing Trend: How Other States Are Responding

New Jersey is not the only state reevaluating the financial impact of pet ownership. As inflation drives up the cost of pet food and veterinary care, lawmakers in several jurisdictions are exploring ways to ease the burden on households.

In New York, legislators are considering tax relief for routine pet care and veterinary expenses, which could yield up to $900 in credits depending on household circumstances. A separate New York proposal aims to eliminate sales tax on pet food entirely, recognizing it as a major, unavoidable household expense.

Meanwhile, California lawmakers have periodically introduced measures focused on adoption costs and veterinary care. Although none of these major proposals have yet been enacted, the growing momentum indicates a significant shift in legislative priorities across the country.

Current IRS Rules: Are Pets Deductible Now?

While state-level debates grab headlines, it is vital to understand the current federal reality. Under existing IRS regulations, pets are considered personal property, not dependents. This means your everyday expenses for food, boarding, and routine veterinary care are strictly non-deductible.

However, there are limited exceptions where animals intersect with business or medical needs. Taxpayers may be able to deduct expenses for qualified service animals, animals used directly in income-producing activities, or specific charitable rescue operations.

For the small business owners we serve at Ez Tax Preparation, one notable exception is a guard dog used to protect a business property—such as a construction yard or restaurant equipment lot. In these narrow scenarios, certain costs may qualify as ordinary and necessary business expenses. But for the average family pet, federal tax breaks do not currently exist.

The Broader Push for Evolving Tax Policy

Why are lawmakers suddenly prioritizing pet-related tax breaks? The answer lies in the sharply rising cost of living. Proponents argue that helping families afford pet care provides essential mental health benefits and could reduce abandonment, alleviating overcrowding at local animal shelters.

Federal conversations are also beginning to evolve. For instance, the proposed PAW Act suggests allowing certain veterinary expenses to be paid with Health Savings Account (HSA) and Flexible Spending Account (FSA) funds. Whether these specific efforts succeed or fail, treating pets as a recognized financial priority is no longer an outlier idea.

Preparing for Shifting Tax Laws

You cannot claim Fido as a dependent on your return this year, but the tax conversation surrounding pets is evolving faster than many realize. While we wait to see if these state and federal proposals become law, it is a great reminder that tax codes are constantly shifting—and keeping up with those shifts is exactly what we do.
